Job Description - Federal Regulatory Attorney

We are currently seeking a talented, motivated and solution-focused individual for a mid-level to senior federal regulatory attorney position. The successful candidate will perform legal services required by TEP and its affiliated companies (collectively “Company”). The Company’s service territory is in Arizona and the successful candidate must be a Tucson, Arizona resident or willing to move to Tucson.  Relocation assistance will be provided for the successful candidate.  Hybrid work in Tucson available.

 

Position Description and Related Responsibilities

 

 Specific responsibilities include, but are not limited to, the following:

 

·         Serves as lead federal regulatory counsel, providing advice and counsel to all levels of management and multiple corporate client groups primarily on matters subject to regulation by the Federal Energy Regulatory Commission ("FERC") and North American Electric Reliability Corporation ("NERC"), as well as a broad range of other federal regulatory compliance and corporate governance matters.

·         Leads and oversees the Company’s FERC and NERC compliance programs.

·         May oversee or supervise other internal regulatory counsel and compliance personnel.

·         Advises on and oversees compliance with federally regulated tariffs and rate schedules and prepares and files new and revised tariffs and rate schedules.

·         Monitors new rulemaking and policies and performs research and analysis of the Company’s factual and legal position regarding various regulatory and related matters, including consideration of applicable law, strategy, risk mitigation and other methods for protecting the Company's interests in the context of existing and potential federal regulatory and other legal proceedings.

·         Advises on and assists in the development, implementation and oversight of Company policies, procedures and controls for compliance.

·         Provides necessary training to Company personnel to ensure overall corporate compliance.

·         Represents the Company in regulatory proceedings and compliance audits before the FERC, NERC and Western Electricity Coordinating Council (“WECC”), potentially including motion practice, discovery, oral arguments, examining witnesses, preparing briefs, audit data requests and interviews of Company personnel, with support of outside counsel as determined appropriate.

·         Prepares and files various compliance documents.

·         Reviews, drafts, negotiates and advises on federally regulated contracts, such as transmission service agreements, power purchase agreements and interconnection agreements.

·         Communicates and collaborates with people throughout the Company and external industry peers and regulators, as appropriate, to achieve Company objectives and foster positive relationships.

·         Participates in industry peer groups and trade organization activities representing the Company’s interest in industry initiatives, policies, and regulatory filings, and to maintain compliance best practices.

·         Performs project leadership functions to coordinate, develop and present the Company's position on a variety of regulatory and contract matters.

·         Works with and manages outside legal counsel and consultants and budgets for the same.

·         May perform any other duties as may be assigned.

Knowledge, Skills & Abilities (Equivalent combination of education and experience will be considered.)

 

Minimum Qualifications

 

·         Degree from ABA-accredited law school.

·         Admitted or ability to become admitted to practice law in the State of Arizona.

·         Experience related to the FERC, NERC and/or WECC or other regulatory or administrative law practice preferred.

·         Ability to travel on occasion as determined necessary for the relevant matter(s).

·         Ability to successfully perform the above position-related responsibilities and on more-complex matters with oversight and guidance.

·         Superior academic record and excellent written and verbal communication and organizational skills required.
