Position Summary

Position is responsible for performing weights and measures enforcement activities, primarily conducting field examinations of commercial weighing and measuring devices and associated legal reporting and enforcement actions to ensure compliance with state statutes pertaining to weights and measures. The employee must be able to thoroughly and accurately document investigation activities as well as read and interpret complex weights and measures regulations. Contacts may be adversarial in nature, and the employee must use skill and judgment to resolve both interpersonal and technical problems encountered in day-to-day activities.

Position Responsibilities

Employee conducts in-depth examinations of weighing and measuring devices in the field. Each examination consists of an inspection to verify compliance with established specifications standards, and a test to ensure devices are performing properly and within prescribed tolerances. The employee examines retail motor-fuel dispensers ("gas pumps") at fueling stations; Class III weighing devices at grocery stores, other retail establishments, and in warehousing and industrial environments; various non-commercial weighing devices as necessary; and taximeters.


As the employee earns certifications, the employee may examine Class I and II weighing devices in pharmacies, jewelers and precious metals outlets, laboratories, and grain elevators; various non-commercial weighing devices as necessary; taximeters; "grandfathered" devices; vehicle and medium-capacity scales; high-flow meters and vehicle-tank meters; and conducts package checking and method of sale regulation compliance inspections.


Performs all required legal enforcement actions prompted by field examinations; completion of thorough and detailed inspection reports; and pursuant to IC 24-6-3-7, sealing approved devices or condemning rejected devices out of service until they can be brought into compliance with the state Standard. Educates business owners to understand their role and responsibility in ensuring fair transactions and maintenance of commercial weighing and measuring equipment.


Investigates consumer complaints, performing specialized tests of devices to detect abnormal performance. Complaints may be urgent in nature; flexibility in prioritizing daily workload is essential as immediate action in the interest of public safety may be required.


Completes all required reading, studying, and training sessions and exercises as assigned to maintain current working knowledge of weights and measures regulations, guidelines, examination procedures, measurement systems, and tolerance theory, including relevant state statutes and sections of the National Institute of Standards and Technology (NIST) Handbooks 44, 112, 130, and 133. Ongoing self-study is required, as well as attendance at locally-offered NIST training seminars.


Maintains all assigned equipment in good condition at all times, including vehicles, technology, field tools, and test standards and informs the County Inspector of any damage immediately.


Assembles daily reports of inspections, maintains copies of all reports in an established data management system, prepares these for archiving, and performs other office or job-related duties as required.


Employee in this position reports to and serves as a deputy inspector under the direction of the County Inspector of Weights and Measures, Supervisor of the Weights and Measures Section. Depending on operational needs, the employee may work independently under minimal supervision, in a team setting with other weights and measures inspectors, or at times under the supervision of the County Inspector. Must be able to work positively, effectively, and constructively as a member of a team.

Qualifications

Associate's degree or Bachelor's degree AND two (2) or more years relevant work experience is required. Relevant work experience could include: prior service in weights and measures enforcement or legal metrology; law or code enforcement; servicing/repairing commercial weighing or measuring devices; or employment in related technical, scientific, calibration, mechanical, quality control, or engineering fields.


A general knowledge of physics, fluid dynamics, and the ability to perform mathematical and statistical calculations is required. Current working knowledge of weights and measures regulations, guidelines, examination procedures, measurement systems, traceability, and tolerance theory, including relevant state statutes and sections of the National Institute of Standards and Technology (NIST) Handbooks 44, 112, and 130, as well as established policies of the City of Indianapolis-Marion County, Department of Code Enforcement, and the Weights and Measures Section is strongly preferred. Familiarity with commercial weighing and measuring devices in common use and NIST Handbooks 133 and 105 series is preferred.


The ability to routinely perform moderately heavy physical labor in extreme conditions for long periods of time requiring dexterity, mechanical aptitude, and problem-solving skills is required. The employee must be able to drive at night and inspect in places with a low light level. The ability to tolerate loud and constant noise continuously, as well as exposure to dust, dirt, odors, and potential chemicals is required. Must be capable of riding as a passenger in a taxicab multiple times per day in the regular course of inspections.


The ability to frequently perform physical activities such as: prolonged standing and walking; lifting, pulling, and pushing; balancing, bending, crouching, kneeling, and stretching; climbing up and down steps or ladders; repetitive hand, wrist, or foot motions; tight or firm gripping with either or both hands; coordinated skillful movements of fingers or arms, including fine manipulation of small items in confined spaces, is required. Must be able to frequently lift, hold, and carry up to 50 pounds. Must be able to repeatedly lift, move, and manipulate a full test weight kit, weighing in excess of 35 pounds; must be able to repeatedly lift, move, and manipulate stainless steel weights ranging from 2 lb to 1/16 oz, individually and in groups. Must be able to repeatedly push, pull, manipulate, lift, pour, and drain a full 5 gallon test measure. Must be able to push, pull, and maneuver up to 200 pounds, and repeatedly lift and manipulate multiple 25 pound cast iron weights.


Ability to communicate effectively both verbally and in writing. Must be able to utilize a computer for word processing functions, entering inspection results into established data management systems, research and study, email, etc.


Must possess and retain a valid Indiana operator's license as the ability to operate a City vehicle is required. Familiar with City streets and able to read maps.

Independent Judgment

Actions are controlled through the application of established weights and measures standards, statutes, regulations, guidelines, and City policies and procedures. Employee utilizes independent judgment when determining compliance with state statutes and other regulations and policies, and determines the appropriate action to be taken.


Employee regularly interacts with others in the Department of Code Enforcement, other City departments, County and State agencies, business owners and their representatives and employees, and the general public. Contacts may become adversarial or hostile at times, and such interactions require the use of diplomacy and tact when enforcing all regulations.


The County Inspector is generally available and can be called if the inspector needs guidance or assistance while performing his/her duties in the field.

1. All employees hired/rehired after 1/1/2022 have a choice to select the PERF Hybrid plan (3% + Pension) or the INPRS My Choice: Retirement Savings plan (3% + 1% Contribution). The Hybrid plan consists of two components:

Annuity Savings Account (ASA) -This consists of the mandatory employee contribution of three (3%) percent of compensation (made for the employee by the City), plus interest credits or earnings. You're always vested in your ASA portion - it's always yours.

Pension - The pension portion of the retirement benefit is funded by contributions made by the employer over the course of the employee's career and separate from the annuity savings account. Employees enrolled in the PERF Hybrid plan are eligible for retirement benefits at age sixty-five (65) if they have ten (10) or more years of creditable service. After June 30, 1995, employees may retire at age sixty (60) with at least fifteen (15) years of credible service or if the member's age in years plus the years of credible service equals at least 85 and the member is at least fifty-five (55) years of age. With fifteen (15) or more years of creditable service, the employee may retire as early as age fifty (50) with a reduced pension.

2. Employees hired/rehired by the City and County between 1/1/2017 and 12/31/2021 will be automatically enrolled in the PERF My Choice: Retirement Savings plan. This plan is an annuity savings account (ASA) only plan and does not have a pension component. Any service that an employee has in the My Choice: Retirement Savings Plan will not count toward the service time requirements for pension eligibility in the Hybrid Plan.

With the PERF My Choice: Retirement Savings Plan, the ASA is split up into two parts:

Part one - This consists of the mandatory employee contribution of three (3%) percent of compensation (made for the employee by the City), plus interest credits or earnings. You're always vested in your ASA portion - it's always yours.

Part two - This consists of an additional variable rate contribution paid by the City toward your ASA. This variable rate contribution is currently 1% of your gross wages. Vesting in the value of the variable rate employer contribution will vary by length of participation. You are:

• 20 percent vested after 1 full year of participation

• 40 percent vested after 2 full years of participation

• 60 percent vested after 3 full years of participation

• 80 percent vested after 4 full years of participation

• 100 percent vested after 5 full years of participation

3. All employees hired/rehired prior to 1/1/2017 are grandfathered into PERF Hybrid plan. The Hybrid plan consists of two components:

4. City Employees hired/rehired between 1/1/2017 and 12/31/21 that are members of the City AFSCME labor union can choose to enroll in either the PERF My Choice: Retirement Savings plan or the PERF Hybrid plan. Both plans are described above. Employees have 60 days to choose which option they want, and by state law this cannot be changed. If no choice is made, the employee will then be automatically added to the PERF My Choice: Retirement Savings plan.

The Indiana General Assembly has enacted a provision that allows public employees to make voluntary contributions in addition to the mandatory three percent (3%) contributions. Employees may contribute up to an additional ten- percent (10%) of their compensation per pay period to the annuity savings account. This means that the maximum level of contributions to the annuity savings account under this new provision is thirteen percent (13%) of an employee's compensation per pay period.

Employees who separate from the city within their first ten (10) years of employment need to contact INPRS - PERF regarding their ASA account.
